Jack van Oers from Brabant successfully sued a casino in Tiel for failing to comply with healthcare legislation. He almost lost four large bets, but should have protected himself from harm. According to BN DeStem, Mall will now have to pay off his gambling debts.
The former boxer and doorman from Breda Life fell apart six years ago when his girlfriend's IVF treatment failed and his dog Indy died. He fled home to seek refuge in gambling at Teal's Grand Casino.
Using drugs while gambling
While gambling, Jack took cocaine. A lot of cocaine. "I always carry a can of Mentos, it's cola, not gum. I sit behind the machine and sniff it with a spoon. People who use drugs in casinos are thrown out and blacklisted. Casinos have a responsibility to protect addicted gamblers from themselves: the so-called duty of care. Jack's casino failed, he believed. So he sued the casino.
Gran Casino Tiel denies, but testified in court that around Christmas 2016, a casino employee found Jack's filled Mentos jars. The Breda man was blacklisted but falsely claimed there were drugs in the jar. He was given the benefit of the doubt and allowed to return. He later demanded that the casinos themselves introduce voluntary entry bans. Since he had no passport photo, he could not do so.
The court has now concluded that the casino should have intervened and breached its duty of care. They must pay damages. The only question is how high that amount will be. According to his own estimates, The Shepper came to 379,000 euros. Casinos did not agree with him. They proposed a settlement of 15,000 euros. Jack does not accept it: that 15,000 euros is not even close to what I think I am entitled to.
