Media Commissioner and Gaming Commission supervise gambling advertisements

The Dutch Media Authority and the Dutch Games of Chance Authority are going to cooperate in order to better monitor advertisements for games of chance. It will concern advertisements on TV and radio, in shops and on billboards as well as online. After a year, the cooperation will be evaluated and, if desired, adjusted.

In this cooperation, the two parties will pay attention to what is not allowed in the field of advertising games of chance and they will handle complaints and comments.

The main reason for this new cooperation is because of the new upcoming law on remote gaming (Koa). As of 1 October 2021, providers of online casino games may offer their services to the Dutch market, provided they have a licence recognised by the Ksa. Because of this, it is necessary to look at when these companies are allowed to advertise. The Commissariat will supervise this.

The new law Koa comes as a supplement to the Media Act of 1 November 2020, which already decided that advertisements relating to games of chance may only be broadcast in separate time slots. With the new law, these rules will be further tightened. Providers may not advertise on TV and radio between 6 am and 9 pm. This will also apply to online advertisements. Furthermore, the Ksa will keep an eye on the content of the advertisements. Gambling providers are not allowed to announce misleading messages or encourage people to play problematically. The advertisements may also not be directed at vulnerable target groups.
