Jack’s Casino Fought a €400,000 Fine. The Court Said No.

Jack’s Casino & Sports has officially lost its legal battle against the Dutch gambling regulator. The result: a €400,000 fine stays exactly where it is.

Promotional messages to players aged 18 to 23

The case goes back to the early days of the regulated Dutch online gambling market. Between late 2021 and early 2022, Jack’s sent promotional messages to players aged 18 to 23. That group sits in a legal no-man’s-land: allowed to gamble, but not allowed to be targeted.

The Dutch Gambling Authority saw that as a clear violation. Jack’s disagreed and went to court. That didn’t last long.

The judge ruled that the rules were clear enough and that licensed operators are expected to know what they’re doing. “We didn’t know yet” wasn’t accepted as a defense.

This ruling matters because it kills a common argument in one go. The idea that the first months of regulation were some kind of grace period. They weren’t. They never were.

If you held a Dutch license, you were expected to comply. If you didn’t, you pay.
